What Laws Protect Against Domestic Violence?

Protection of Women from Domestic Violence Act, 2005

This is a civil law designed to give women quick, practical protection. It covers wives, women in live-in relationships, mothers, sisters and daughters who have lived in a shared household with the abuser. A Magistrate can pass five main kinds of orders: a protection order stopping the abuser from committing violence or contacting you, a residence order protecting your right to stay in the shared home, monetary relief for expenses and lost earnings, temporary custody of your children, and compensation for the harm you have suffered. Urgent interim orders can be passed even before the final hearing. Breaking a protection order is itself a crime, punishable with jail of up to one year, a fine of up to twenty thousand rupees, or both.

Bharatiya Nyaya Sanhita, 2023 (replacing the IPC)

From 1 July 2024, the old Section 498A IPC on cruelty by a husband or his relatives became Sections 85 and 86 of the Bharatiya Nyaya Sanhita. Cruelty includes conduct that is likely to drive a woman to harm herself or that seriously endangers her life, health or mental wellbeing. It is punishable with up to three years in prison and a fine. The BNS also covers hurt, criminal intimidation and other offences.

Other Supporting Laws

Section 144 of the Bharatiya Nagarik Suraksha Sanhita (formerly Section 125 CrPC) allows a woman to claim monthly maintenance, and the Bharatiya Sakshya Adhiniyam, 2023, which replaced the Evidence Act, governs how proof such as medical records, messages and recordings is presented in court.
