Alimony & Maintenance

Alimony and Maintenance Lawyers in Delhi NCR

When a marriage runs into trouble, one of the first worries is money. How will the rent be paid? Who will cover the children's school fees? Alimony and maintenance law answers exactly these questions. In simple words, maintenance is regular financial support that one family member must legally give another who cannot support themselves. Alimony usually means the support a spouse receives when a divorce ends, either monthly or as a one-time lump sum. It is not charity and it is not a punishment. It is a legal right that protects dignity, so no wife, husband, child or elderly parent is left without shelter, education or medical care.

What Laws Govern Alimony and Maintenance in India?

Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 125 CrPC)

Since 1 July 2024, the well-known Section 125 of the old Criminal Procedure Code has been replaced by Section 144 of the BNSS. It lets a wife, children and parents who cannot maintain themselves ask a Magistrate to order monthly support from a person who has enough means but refuses to pay. It applies to people of every religion and is designed to be quick. Temporary (interim) maintenance can be ordered while the case is running, and the law asks that such requests be decided, as far as possible, within sixty days.

Hindu Marriage Act, 1955

Section 24 lets either spouse, husband or wife, claim interim maintenance and legal expenses while a divorce or other matrimonial case is pending. Section 25 lets the court grant permanent alimony at the time of the decree or later, looking at the income, property and needs of both sides.

Hindu Adoptions and Maintenance Act, 1956

Section 18 gives a Hindu wife the right to be maintained by her husband during the marriage, and even to live separately with maintenance in situations such as cruelty or desertion, without filing for divorce. The Act also protects children and aged parents.

Other Laws That Can Help

Couples married under the Special Marriage Act, 1954 have similar rights to interim and permanent alimony. The Protection of Women from Domestic Violence Act, 2005 lets a woman facing abuse claim monetary relief, and the Family Courts Act, 1984 ensures most of these claims are heard by dedicated family courts. Courts adjust amounts where claims are made under more than one law, so choosing the right route from the start matters.
