Child Custody

Child Custody Lawyers in Delhi NCR

For any parent, nothing matters more than their children. When a marriage breaks down, the hardest question is often where the children will live and how each parent will stay part of their lives. Child custody law deals with exactly this. Custody means the right to have the child live with you and to care for them day to day. Guardianship is the wider legal authority to make important decisions about the child's education, health and property. Visitation, sometimes called access, allows the other parent to spend regular time with the child. Indian courts do not treat children as property to be divided. Their single focus is what is truly best for the child.

Types of Custody

Courts can grant sole physical custody to one parent with visitation for the other, joint custody where both parents share time and responsibility, or legal custody where both parents take major decisions together even if the child lives mainly in one home. Temporary custody can also be ordered while the case is going on.

What Laws Govern Child Custody in India?

Guardians and Wards Act, 1890

This is the main custody law that applies to families of every religion. It allows a parent or relative to ask the court to appoint a guardian or to hand over custody of a child. In Delhi, these cases are heard by the family courts.

Hindu Minority and Guardianship Act, 1956

For Hindus, Sikhs, Jains and Buddhists, this Act names the natural guardians of a child. It says that custody of a child below five years of age should ordinarily be with the mother. Most importantly, Section 13 states that the welfare of the child is the paramount consideration, which means it outweighs the wishes or rights of either parent.

Hindu Marriage Act, Special Marriage Act and Family Courts Act

During a divorce or separation case, Section 26 of the Hindu Marriage Act, 1955 and Section 38 of the Special Marriage Act, 1954 allow the court to pass orders on custody, maintenance and education of children, and to change those orders later if circumstances change. The Family Courts Act, 1984 created specialised courts that encourage settlement and child-friendly hearings.

What Do Courts Look At?

Judges consider the child's age, emotional bonds, schooling, health, the home environment each parent can offer, and, where the child is old enough, the child's own wishes. Money alone does not decide custody. A parent who earns less can still be the better primary caregiver.
