Family Mediation

Family Mediation Lawyers in Delhi NCR

Not every family dispute has to become a long courtroom battle. Family mediation is a private, voluntary process in which a trained, neutral mediator helps family members talk calmly, understand each other's concerns and reach their own agreement. The mediator does not take sides or pass judgments. Instead, the mediator guides the conversation so that practical solutions can be found on issues such as separation, divorce terms, alimony, child custody and visitation, return of belongings, and even property disputes between relatives. Everything said in mediation is kept confidential, which lets people speak honestly without fear.

What Laws Support Family Mediation?

The Family Courts Act, 1984 requires family courts to first make efforts to help the parties settle their dispute, and allows them to adjourn cases to give settlement a real chance. Section 23 of the Hindu Marriage Act, 1955 places a similar duty on courts to try to bring about reconciliation before granting relief in most cases, and Section 89 of the Code of Civil Procedure allows courts to refer disputes to mediation. The Mediation Act, 2023 is India's first dedicated law on mediation. It recognises voluntary pre-litigation mediation, online mediation and enforceable mediated settlements, and the Mediation Council of India has been established under it. Its provisions are being brought into force in stages, while the settlement framework of the Family Courts Act continues to apply to family cases.

Pre-Litigation Mediation

Pre-litigation mediation happens before any case is filed in court. It is ideal for couples and families who want to separate or resolve a disagreement with dignity, privacy and lower costs. In Delhi, it can be conducted at Samadhan, the Delhi High Court Mediation and Conciliation Centre, which was formally inaugurated on 26 May 2006 and also undertakes mediation before a case is filed in court, through the Delhi State Legal Services Authority and the mediation centres in the district court complexes, or with a private mediator both sides trust. Sessions can even be held online, which helps when one spouse lives in another city or abroad.

A settlement reached at this stage can form the basis of a quick mutual consent divorce, a maintenance arrangement or a parenting plan, often saving years of litigation. Because nobody has yet filed allegations in court, relationships, especially with children and extended family, are far easier to protect.

Post-Litigation (Court-Referred) Mediation

Post-litigation or court-referred mediation takes place after a case has already been filed. Family courts in Delhi routinely refer divorce, maintenance and custody matters to the court-annexed mediation centres at Saket, Tis Hazari, Rohini, Dwarka, Karkardooma and Patiala House, and the Delhi High Court refers matters to Samadhan. Family courts in Gurugram and Noida follow a similar practice. The case is paused while trained mediators help both sides explore a settlement.

If an agreement is reached, it is written down, signed and placed before the court, which can then pass orders or a decree on those terms. Even long-running criminal complaints connected with a matrimonial dispute can sometimes be closed after a genuine settlement. If mediation does not succeed, the case simply continues, and what was said in mediation is generally kept out of the court record.
