What Laws Deal With Dowry Harassment?

Dowry Prohibition Act, 1961

This Act makes both giving and taking dowry a crime, punishable with at least five years in prison and a fine of at least fifteen thousand rupees or the value of the dowry, whichever is more. Simply demanding dowry is also a crime, carrying six months to two years in prison and a fine of up to ten thousand rupees. Any dowry received must be passed on to the woman, and the Act provides for Dowry Prohibition Officers to help enforce it. Voluntary gifts given without any demand are treated differently, which is why careful legal advice matters.

Bharatiya Nyaya Sanhita, 2023 (formerly the IPC)

Since 1 July 2024, cruelty by a husband or his relatives, earlier Section 498A IPC, falls under Sections 85 and 86 of the BNS. Harassing a woman or her family to meet an unlawful demand for property or money is expressly treated as cruelty and can lead to up to three years in prison and a fine. The most serious offence, dowry death, earlier Section 304B IPC, is now Section 80 of the BNS. It applies where a woman dies in unnatural circumstances within seven years of marriage after facing dowry harassment soon before her death, and carries at least seven years and up to life imprisonment. Holding back a woman's streedhan can also be a criminal breach of trust under Section 316 of the BNS.

BNSS, BSA and the Domestic Violence Act

Complaints are investigated under the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced the CrPC. Under Section 118 of the Bharatiya Sakshya Adhiniyam, 2023 (formerly Section 113B of the Evidence Act), once dowry harassment soon before a death is shown, the court presumes the accused caused the dowry death. A woman can also seek protection, residence and monetary orders under the Protection of Women from Domestic Violence Act, 2005.
